The legal term for obtaining a divorce in North Carolina is known as an absolute divorce. The first step in being awarded an absolute divorce in North Carolina is living separate and apart from your spouse for one year or more. Once you and your spouse have been separated for more than one year, you may file a complaint for divorce with the court. Upon filing the complaint, your spouse must be served with a copy of the complaint. After proper service has been completed, your spouse has 30 days to file an answer with the court. If no answer is filed, you may motion the court to grant your divorce.
